These RULES FOR USING THE SITE (hereinafter referred to as the Rules) have been developed in accordance with Articles 11, 641, 642, 646, 698-711 of the Civil Code of Ukraine, Article 12 of the Law of Ukraine “On Electronic Commerce”, Article 13 of the Law of Ukraine “On Protection of Consumer Rights” and regulate the relationship between the Individual Entrepreneur Kalekin Vasyl Mykolayovych (hereinafter referred to as the “Individual Entrepreneur”), as the administrator of the site https://global-fishing.com.ua/ , and any individual (hereinafter referred to as the User) regarding the use of the site https://global-fishing.com.ua/
1. TERMS AND DEFINITIONS
In these Rules, the following terms and definitions have the following meanings:
* "Individual Entrepreneur" - Individual Entrepreneur Kalekin Vasyl Nikolaevich (Individual Entrepreneur Kalekin Vasyl Nikolaevich). After accepting (accepting) the offer, the Individual Entrepreneur acts as the Seller.
* "User" is an adult, capable individual who has accessed the Site and continues to use it under the terms and conditions set forth in these Rules.
* "Site" - the website of an individual entrepreneur, which contains information about goods, terms of their purchase, payment, delivery, promotions, advertising and marketing activities, other general information, other mandatory information, in graphic and/or textual form, addressed to an unspecified circle of persons, on the basis of which any person can make a conscious choice and contact the individual entrepreneur with an offer to conclude a retail contract for the purchase and sale of goods on the terms set out in these Rules.
* "Offer" – the User's choice of one item from the list of products posted on the Site by adding the selected product to the "basket", further entering the information necessary to place an order, and clicking the "place an order" button (hereinafter also referred to as "placing an order").
* "Goods" - fishing tackle, rods, reels, fishing feeders, sinkers, bait, fishing lures, fish care products, equipment, clothing, accessories, components and accompanying items, as well as any other tangible or intangible objects, information about which is posted on the Site.
* "Authorization" - receipt by an individual entrepreneur of data, including personal data, of the User while visiting the Site and/or in the process of sending an offer (placing an order). Authorization while on the Site is carried out by the User at his/her request. Authorization when placing an order is mandatory.
* "User Verification" - establishment (confirmation) by the Individual Entrepreneur of the correspondence of the User's identity in his presence to the identification data obtained on the Site.
* “Legislation” – the current legislation of Ukraine, which may be applied to legal relations related to the implementation and/or arising from the implementation of the obligations described in these Rules.
2. GENERAL TERMS AND CONDITIONS
2.1. By remaining on the Site, the User accepts the terms and procedure for sending an offer to an Individual Entrepreneur (placing an order) and accepting the offer by the Individual Entrepreneur, and also gives the Individual Entrepreneur consent to the processing of personal data provided by him and other information that he considers necessary to provide, or which is mandatory for provision under the Legislation, and also accepts the terms of liability for unscrupulous use of the Site.
2.2. The individual entrepreneur presumes that all actions taken on the Site (including placing an Order) are aimed at purchasing Goods for personal needs not related to entrepreneurial activity. The User placing an Order as an individual does not have the right to demand the provision of primary or other documents, the production of which is not provided for by law for retail trade with citizens. The sale of Goods to legal entities and individual entrepreneurs (IEPs) with the execution of the relevant primary documents and non-cash payment is carried out on the basis of separately concluded supply contracts in accordance with the legislation of Ukraine.
2.3. The Individual Entrepreneur informs that the information about the Goods (including prices, specifications and images) posted on the Site is for informational purposes only and may be changed by the Individual Entrepreneur unilaterally at any time without prior notice. The final price is the price indicated in the Individual Entrepreneur's acceptance sent in response to the User's offer (order confirmation).
2.4. The Individual Entrepreneur does not check (verify) the accuracy of personal data and other information provided by the User during registration, authorization or placing an Order on the Site. All information is accepted "as is" without additional verification and is the sole basis for processing documents and fulfilling the Order. The risks of any adverse consequences associated with the provision of inaccurate or erroneous information are fully borne by the User.
2.5. The text of these Rules is the intellectual property of the Individual Entrepreneur and is protected by the Law of Ukraine "On Copyright and Related Rights". Any use, copying or distribution of this text (or parts thereof) without the official permission of the copyright holder is prohibited.
2.6. The Seller has the right to unilaterally change the terms of these Rules at any time. The new version of the Rules shall enter into force from the moment of its posting on the Site. The User is obliged to independently familiarize himself with the current version of the Rules each time he visits the Site.
3. PROCEDURE FOR CONCLUSION OF AGREEMENTS FOR THE USE OF THE SITE
3.1. Information about the Goods posted on the Site is an invitation to Users to make offers to conclude a contract (send an offer) in accordance with Art. 641 of the Civil Code of Ukraine and is not an offer of an individual entrepreneur. This is due to the fact that the assortment, availability and characteristics of the Goods may change, the Goods may be discontinued or completely sold out, its price may be changed both in the direction of increase and decrease, and any promotions, discount programs or sales may be applied, changed or canceled in relation to the Goods.
3.2. After reviewing the information posted on the Site, the User has the right to send the Individual Entrepreneur an offer to conclude a contract (offer). Such an offer is made by independently placing an Order on the Site or by telephone at the phone number indicated on the Seller's site. Sending an Order is considered an offer by the User to purchase the selected Product on the terms specified in this Order.
3.3. Placing an Order by the User confirms that he has fully familiarized himself with the description of the Product, its technical and other characteristics, price and terms of sale. Also, by these actions, the User certifies that the selected Product fully meets the purpose of its purchase, and the User himself bears full sole responsibility for the conscious choice of the Product and its compatibility.
3.4. Acceptance of the User's offer by the Individual Entrepreneur is the performance of actions indicating the intention to conclude an agreement on the terms proposed in the Order, namely: actual shipment (transfer to the logistics company for delivery) of the selected Goods to the Buyer.
3.5. The Seller has the right to offer the User to purchase the Goods on other terms (for example, in the event of a price change or the absence of a certain item in stock). Such an offer is considered a counter-offer. Acceptance of a counter-offer by the User is the actual receipt of the Goods by him and/or payment for it on new terms. The Seller has the right to withdraw the counter-offer at any time until the actual receipt of the Goods by the User.
3.6. The User, in confirmation of his intention to conclude a contract, has the right to make a prepayment for the Goods in the amount of the price specified in the Order. In the event of acceptance of the Order by the Seller, these funds are credited as payment for the Goods. If the Seller rejects the User's offer (does not accept the Order), the funds transferred by the User are subject to a full refund in accordance with the requirements of the legislation of Ukraine.
3.7. The terms of concluded contracts for the purchase of goods are regulated by the norms of the Civil Code of Ukraine, the Law of Ukraine "On Protection of Consumer Rights".
3.8. The terms of exchange and return of goods are generally accepted and are regulated by the norms of current legislation on consumer protection. Certain goods are not subject to return and exchange in accordance with the rules of the Resolution of the Cabinet of Ministers of Ukraine dated March 19, 1994 N 172 “On the implementation of certain provisions of the Law of Ukraine “On Consumer Protection” ( https://zakon.rada.gov.ua/laws/show/172-94-%D0%BF#Text)
4. CIRCUMSTANCES OF FORCE MAJEURE (FORCE MAJEURE).
4.1 The individual entrepreneur (seller) and the User are not liable for failure to fulfill any of the provisions if they prove that such failure was caused by force majeure, i.e. events or circumstances that are truly beyond their control, that are unforeseen and unavoidable.
4.2 Force majeure circumstances include, but are not limited to, natural disasters, strikes, fires, floods, explosions, frost, wars (both declared and undeclared), declaration of martial law or states of emergency, conduct of anti-terrorist operations (both declared and undeclared), epidemics, epizootics, introduction of full or limited quarantine, emergency regime, state of emergency, introduction of lockdowns, prohibitions or restrictions on the implementation of certain types of economic activities, riots, loss of goods, delays of carriers caused by accidents or adverse weather conditions, dangers and accidents at sea, embargoes, catastrophes, restrictions imposed by state authorities (including allocations, priorities, official requirements, quotas and price controls), if these circumstances directly affected the performance of the obligations assumed.
4.3 A person who is unable to fulfill his obligations due to force majeure must immediately inform the other party.
